Terms of Service

Buddy2Buddy ("Platform", "we", "us", or "our") is an online activity partner marketplace operated by Buddy2Buddy Technologies Private Limited, incorporated under the Companies Act, 2013, with its registered office in India. Our Platform connects individuals ("Users") seeking companionship for lawful, everyday social activities — including but not limited to shopping trips, temple visits, gym sessions, café outings, morning walks, study sessions, and other recreational pursuits — with vetted, independent activity partners ("Buddies"). Buddy2Buddy is strictly a technology marketplace. We do not employ Buddies. Buddies are independent service providers who offer their time and companionship for lawful social activities. We do not facilitate, promote, or condone any services of a sexual, romantic, or escort nature. Any attempt to use this Platform for such purposes will result in immediate account termination and may be reported to law enforcement.

By accessing or using the Buddy2Buddy Platform — whether through our website (buddy2buddy.xyz), mobile application, or any associated service — you confirm that: (a) You are at least 18 years of age. (b) You have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. (c) You have the legal capacity to enter into a binding agreement under applicable Indian law. (d) If you are using the Platform on behalf of an organisation, you have the authority to bind that organisation to these Terms. These Terms constitute a legally binding agreement between you and Buddy2Buddy Technologies Private Limited. If you do not agree, please discontinue use of the Platform immediately.

3.1 You must be 18 years or older to create an account or use our services. 3.2 You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. 3.3 You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at legal@buddy2buddy.xyz if you suspect any unauthorised access to your account. 3.4 You may not create more than one personal account. Accounts are non-transferable. 3.5 We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion, including where we believe a user is engaging in misuse of the Platform.

4.1 Buddies are independent contractors, not employees, agents, or representatives of Buddy2Buddy. 4.2 To become a Buddy, you must complete our verification process, which includes government-issued ID verification, a reference check, and agreement to our Code of Conduct. 4.3 Buddies agree to provide only lawful social activity companionship as described in their listed services. Any service that is illegal, sexual, romantic, or escort-related is strictly prohibited and will result in immediate removal from the Platform and potential legal action. 4.4 Buddies are responsible for their own conduct, safety equipment (where applicable), transportation, taxes, and compliance with applicable laws during activities. 4.5 Buddies set their own availability and pricing within the bounds of the Platform's guidelines. Buddy2Buddy deducts a platform service fee from each completed booking as disclosed at the time of onboarding.

5.1 All bookings are made through the Platform. Off-platform transactions are a violation of these Terms and forfeit any payment protection or dispute resolution rights. 5.2 Users pay for bookings through our secure payment partners. Payment is collected at the time of booking confirmation. 5.3 Funds are held in escrow until the activity is marked as completed by both parties or after 24 hours of the scheduled activity end time, whichever comes first. 5.4 Buddy2Buddy charges a platform service fee on each transaction. This fee is clearly disclosed before you confirm any booking. 5.5 All prices on the Platform are inclusive of applicable taxes (GST) unless otherwise stated. 5.6 In the event of a payment dispute, please contact support@buddy2buddy.xyz within 48 hours of the scheduled activity. You agree NOT to use the Platform for: (a) Any activity that is illegal under Indian law or the laws of your jurisdiction. (b) Requesting, offering, or facilitating services of a sexual, romantic, or escort nature. (c) Harassment, intimidation, stalking, or threatening any user or Buddy. (d) Sharing false, misleading, or defamatory information in profiles or reviews. (e) Soliciting Buddies to communicate or transact outside the Platform. (f) Impersonating another person or misrepresenting your identity. (g) Attempting to reverse-engineer, scrape, or interfere with Platform systems. (h) Using the Platform if you have been previously banned or suspended. Violation of these prohibitions may result in immediate account suspension, forfeiture of pending payments, and referral to law enforcement where appropriate.

7.1 Buddy2Buddy provides a marketplace platform only. We do not guarantee the conduct, quality, or suitability of any Buddy, nor the accuracy of any profile information. 7.2 To the maximum extent permitted by applicable Indian law, Buddy2Buddy, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform. 7.3 Our total aggregate liability in connection with any claim arising out of these Terms shall not exceed the amount you paid for the specific booking giving rise to the claim. 7.4 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence or fraud.

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. Please review it carefully at buddy2buddy.xyz/privacy.

9.1 These Terms shall be governed by and construed in accordance with the laws of India. 9.2 Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. 9.3 The seat of arbitration shall be Mumbai, Maharashtra, India. The language of arbitration shall be English. 9.4 Subject to the above, the courts of Mumbai, Maharashtra shall have exclusive jurisdiction.

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or in-app notification at least 7 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
